Terms of service

These Terms & Conditions govern your use of magicmilk.bike and any purchase you make from it. The store is operated by Benjamin Rupert Evans (Strategem) (NIE Y3684484J), C. Ramón de la Sagra, 2, 29740 Torre del Mar, Málaga, Spain (“we”, “us”, “our”). By placing an order you accept these terms. For any question, contact believe@magicmilk.bike.

1. Products and prices

All prices are shown in euros (€) and include applicable VAT unless stated otherwise. Delivery costs, where they apply, are shown before you complete your order. We may update prices and product information at any time; the price that applies to your order is the one shown at checkout. Product images are for illustration.

2. Your order and the contract

Your order is an offer to buy. The contract is formed when we send you an order confirmation. We may decline or cancel an order (for example, if an item is unavailable or a pricing error is obvious), in which case we will refund any amount already paid.

3. Payment

Payment is taken at checkout through our secure payment providers. You confirm that you are entitled to use the payment method provided.

4. Delivery

We ship from C. Ramón de la Sagra, 2, 29740 Torre del Mar, Málaga, Spain. Estimated delivery times and any shipping costs are shown at checkout. Risk in the goods passes to you on delivery.

5. Right of withdrawal and returns

If you are a consumer, you have a 14-day right of withdrawal and other rights set out in our Return & Withdrawal Policy, which forms part of these terms.

6. Legal guarantee of conformity

As an EU consumer you benefit from the legal guarantee of conformity. If goods are faulty or not as described, you are entitled to the remedies provided by law (repair, replacement, price reduction or refund). See our Return & Withdrawal Policy and contact believe@magicmilk.bike.

7. Liability

Nothing in these terms limits or excludes liability that cannot be limited or excluded under applicable law (including liability for death or personal injury caused by negligence, fraud, or your statutory consumer rights). Subject to that, we are not liable for losses that were not foreseeable, or that arise from your failure to follow product instructions.

8. Privacy

We process your personal data in accordance with our Privacy Policy.

9. Governing law and dispute resolution

These terms are governed by Spanish law, without affecting the mandatory consumer-protection rights you have in your country of residence within the EU. If you are a consumer and a dispute cannot be resolved with us directly, you may use the European Commission’s Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
